Trademarks

Trademark attorneys for creative brands.

MADE NEXT PC helps fashion labels, agencies, creators and startups clear, register and protect their trademarks with the USPTO and internationally — on flat fees, with most applications filed within 48 hours.

Overview

Own your name. Protect your brand.

A trademark protects the names, logos and slogans that tell customers a product comes from you. Using a mark creates limited common-law rights where you do business, but a federal registration with the U.S. Patent and Trademark Office (USPTO) gives you nationwide priority, the right to use the ® symbol, and far stronger tools to stop copycats.

We start with clearance — making sure your name is available before you invest in it — then file a carefully drafted application, respond to any USPTO objections, and keep watch over your mark once it registers.

FAQ

Trademarks questions, answered.

Do I need a lawyer to file a trademark application?

U.S.-based applicants aren’t required to use an attorney, but it often pays to. Many applications are refused or delayed because of weak descriptions, the wrong classes, or conflicts a proper search would have caught. Applicants based outside the U.S. must be represented by a U.S.-licensed attorney.

How long does trademark registration take?

The USPTO typically takes several months to examine a new application, and the full process to registration commonly runs a year or longer depending on office actions and oppositions. We file most applications within 48 hours of your approval so your priority date is secured as early as possible.

What is the difference between ™ and ®?

You can use ™ with any name or logo you claim as a brand, registered or not. The ® symbol may only be used once the USPTO has registered the mark, and only for the goods and services listed in the registration.

Can I trademark a name I’m not using yet?

Yes. An intent-to-use application reserves your priority date before launch. The registration is issued after you show the USPTO that the mark is in actual use in commerce.

What is a USPTO office action?

An office action is a letter from the USPTO examining attorney raising legal or procedural problems with an application. Responses are generally due within three months, with one three-month extension available for a fee. A well-argued response can overcome many refusals.

Do trademark registrations expire?

A U.S. registration can last indefinitely, but you must file a declaration of use between the fifth and sixth years after registration and renew every ten years. Missing these deadlines cancels the registration.
